German courts say: pay journalists fairly

THE HIGHER Regional Court in Munich ruled on 21 April that a substantial part of contracts "offered" the Süddeutsche Zeitung are illegal. It overrode a a judgement of the Munich District Court in favour of the newspaper, accepting arguments by the unions that in particular a lump sum payment for all rights breaches the principle of fair remuneration for uses by the publisher.

Also, the Higher Regional Court of Hamburg ruled in similar terms on 1 June that the contracts "offered" by the Bauer magazine group are illegal in Germany.

Similarly the Higher Regional Courts of Hamm and Karlsruhe earlier decided in cases against Södkurier and Ruhrnachrichten. All these judgments are on the website of the DJV union.
