Nevada judge rules infringement is ‘fair use’

A NEVADA judge has ruled that quoting an entire newspaper leader article on a blog is "fair use" under US law. Worse, Federaral District Judge Roger L Hunt ruled that only five of the article's 19 paragraphs were sufficiently creative to merit protection.

The Freelance has a feeling that the ruling may have been influenced by irritation at the plaintiff, Righthaven, described as a "copyright mill" - a company that issues mass threats to sue. Hunt ruled that Righthaven did not have legal standing to bring the case at all, since even if the publisher actually did assign copyright in the piece to the company, so that it had standing to sue, this would have been dubious.

We await with interest the outcome of the appeal, if any.
